# What to Know About California's Headlight Laws | Omega Law Group

![What are California's Headlight Laws?](https://www.omegalaw.com/wp-content/uploads/2026/10/californias-headlight-laws.jpg)

California’s headlight laws require two lit headlamps during darkness and whenever weather limits visibility to less than 1,000 feet or calls for continuous wiper use. The same laws set the height and color of your headlamps and tell you when to switch from high beams to low beams.

A driver who ignored them may share the blame for a crash, though a violation alone doesn’t settle who pays. Omega Law Group Accident & Injury Attorneys handles nighttime and low-visibility collisions, and a [car accident lawyer in West Hollywood](https://www.omegalaw.com/west-hollywood/car-accident-lawyer/) on our team can review whether another driver’s lighting played a part.

## When Must You Turn On Your Headlights in California?

You must turn on your headlights in California during darkness, inclement weather, or both, under [Cal. Veh. Code § 24400](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D24400). The law treats each of these conditions as a trigger:

- Any time from 30 minutes after sunset to 30 minutes before sunrise, the period [Cal. Veh. Code § 280](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D280) defines as darkness
- Any time you can’t clearly see a person or vehicle on the road 1,000 feet ahead
- Any time rain, mist, snow, fog, or other moisture requires your wipers to run continuously

A common belief holds that bright streetlights excuse you from using headlights. They don’t. The darkness rule runs on the clock, so a well-lit stretch of Sunset Boulevard at 9 p.m. still requires headlights, the same as an unlit canyon road.

## Do You Need Headlights When Your Wipers Are On?

You need headlights when your wipers are on continuously because of rain, mist, snow, or fog, even in daylight, under § 24400. A single swipe to clear dust or a splash of road spray does not trigger the rule.

Poor visibility can require headlights on its own, wipers or not. Heavy marine layer fog can drop visibility below 1,000 feet on a dry windshield, and the law still applies.

Automatic headlights may not catch these situations. Many systems read outside brightness, so a gray, rainy afternoon may not switch them on. Check your dashboard indicator and turn the headlights on yourself when the weather changes.

## Can Daytime Running Lights or Fog Lights Replace Headlights?

Daytime running lights cannot replace headlights in darkness or bad weather, because § 24400 requires two lighted headlamps that meet the law’s height rules. Many daytime running light systems are dimmer and leave the taillights off, so drivers behind you may not see your car.

Parking lights fall short too. [Cal. Veh. Code § 24800](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D24800) bans driving with parking lamps on unless they are working as turn signals or the headlamps are also lit.

Fog lights can supplement headlights but never substitute for them. Under [Cal. Veh. Code § 24403](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D24403), a car may have no more than two fog lamps, mounted 12 to 30 inches above the ground.

## When Must You Dim Your High Beams?

You must dim your high beams within 500 feet of an oncoming vehicle and within 300 feet when following another vehicle, under [Cal. Veh. Code § 24409](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D24409).

The statute treats your lowest beam setting as glare-free at all times, whatever the shape of the road. So if you’re unsure whether your high beams bother another driver, switching to low beams always satisfies the rule.

Some articles say the 300-foot rule has an exception for passing. The text of § 24409 contains no such exception. If you drive with automatic high beams, stay ready to dim them yourself when the system reacts late on curves or hills.

## What Equipment Rules Apply to Your Headlights?

Every car other than a motorcycle needs at least two headlamps, one on each side of the front, mounted between 22 and 54 inches above the ground, under § 24400. Motorcycles follow separate rules.

Color is the next test. Under [Cal. Veh. Code § 25950](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D25950), light visible from the front of a car must be white or yellow, so blue or purple aftermarket bulbs can draw a citation. Lamps must also be kept in working order under [Cal. Veh. Code § 24252](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D24252), which means one burned-out headlamp can lead to a ticket.

## How Do You Clear a Headlight Fix-It Ticket?

You clear a headlight fix-it ticket by fixing the problem, getting the back of the ticket signed, and delivering it to the court with a transaction fee by your appearance date, according to the [Judicial Council of California](https://www.courts.ca.gov/4070.htm). This works only if the officer checked the correctable violation box under [Cal. Veh. Code § 40610](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D40610).

A law enforcement officer or an authorized inspection station agent can sign the certificate of correction. The [Los Angeles County Sheriff’s Department](https://lasd.org/courtservices/vehicleviolations/) lists § 24400 among the violations that need a certificate from an official headlamp station, which you can find through the [Bureau of Automotive Repair](https://www.smogcheck.ca.gov/).

Missing the deadline turns a simple repair into a fine. A first infraction can carry a base fine of up to $100 under [Cal. Veh. Code § 42001](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DVEH%26sectionNum%3D42001), before court assessments are added.

## How Can a Headlight Violation Affect Your Accident Claim?

Darkness raises the stakes. In 2023, 50% of U.S. traffic deaths happened in the dark, according to the [National Highway Traffic Safety Administration](https://crashstats.nhtsa.dot.gov/Api/Public/ViewPublication/813728). A car with no lights or blinding high beams can leave other drivers with little time to react.

A headlight violation may help show negligence. Under [Cal. Evid. Code § 669](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode%3DEVID%26sectionNum%3D669), breaking a safety law can create a presumption of negligence when the violation caused the injury and the law was meant to prevent that kind of harm. The other driver can still try to rebut it, and your own share of fault may reduce what you recover.

## What Evidence Shows Headlights Contributed to a Crash?

Useful evidence can include:

- Photos and video of both vehicles, street lighting, and weather
- Dashcam or business security footage showing whether headlights were on before impact
- Witness statements describing an unlit car or blinding glare
- The crash report from the [Los Angeles County Sheriff’s Department West Hollywood Station](https://lasd.org/west-hollywood/) or, for freeway crashes, the [California Highway Patrol](https://www.chp.ca.gov/)
- Repair and inspection records showing bulb, wiring, or aiming problems before the crash

A shattered headlamp after impact doesn’t prove the lamp was out beforehand. Bulb filaments and repair records can sometimes answer that question, so they should be preserved before the car is fixed. Medical records from [Cedars-Sinai Medical Center](https://www.cedars-sinai.org/) or another hospital connect the crash to your injuries.

## California Headlight Law FAQs

These answers cover a few follow-up questions drivers ask about lighting tickets and equipment.

### Is It Illegal to Drive With One Headlight Out in California?

It is illegal to drive with one headlight out in California, because § 24400 requires two working headlamps during darkness and bad weather. Officers usually treat it as a correctable equipment violation, so replacing the bulb and getting a sign-off can resolve the ticket.

### Are Blue Headlights Legal in California?

Blue headlights are not legal in California because § 25950 requires light visible from the front of a vehicle to be white or yellow. Bright white LED or HID bulbs can pass, but bulbs that cast a blue tint may not.

### Can a Headlight Ticket Affect an Injury Claim?

A headlight ticket can affect an injury claim, but it doesn’t decide fault by itself. The question is whether the lighting problem helped cause the crash. The lawyers at [Omega Law Group](https://www.omegalaw.com/our-firm/) look at the ticket alongside the rest of the evidence.
