The Dangers of Ridesharing

Lack of regulation and rapid growth have made ridesharing one of the most successful and most legally murky new industries in recent years. Although people love ridesharing apps like Lyft for their convenience and affordability, making sure these companies are operating ethically can be a challenge—especially when it comes to accidents.

Lyft accidents may affect drivers, riders, or pedestrians. If you have been injured in a Lyft accident, you should consider hiring an attorney before talking to your insurance provider or dealing with the company directly. An experienced rideshare lawyer will advocate for you in court, and work to get the monetary compensation you deserve for your pain and suffering.

Omega Law Group, PC can fight for you. Our experienced Lyft accident lawyers have decades of experience dealing with auto accidents, and our contingency fee policy means you won’t pay any fees until we win your case.

A Rise in Accidents

A new study from the University of Chicago and Rice University found that accident rates in the U.S. have climbed as much as 2-3% since 2011, thanks to the rise of ridesharing companies. Research was gathered by looking at accidents in cities where services like Lyft were present and comparing accident rates relative to miles traveled. The report concludes that the amount of time drivers for companies like Lyft spend in their cars, on average, is increasing congestion rates and leading to roughly 1,100 more auto-related fatalities per year.

What This Means for Accident Victims

Lyft ensures all of their drivers for $1 million through York Risk Services Group. As a result, it may be possible to seek greater damages from the company, and seek complete compensation for injuries, repair costs, loss of income, or any other pain and suffering you have experienced as a result of the accident.

Parties entitled to damages in a Lyft accident may include:

  • A motorist or passenger injured in a collision where a Lyft driver is at fault;
  • A Lyft driver inured in a collision with another motorist where said motorist is at fault;
  • A Lyft passenger injured in any kind of collision, regardless of who was at fault; or
  • A pedestrian injured in any kind of Lyft-related collision.

Handling Insurance

Lyft-related incidents where no injury occurred can be resolved through insurance companies, though it is still a good idea to seek legal representation to negotiate the best outcome. Saying the wrong thing to an adjuster can not only hurt your case, cost you a lot of money. Having an attorney guide you through the process may help you avoid a reduction in coverage, or an increase in rates.

Understanding Lyft Coverage

Whether Lyft will cover your accident depends entirely on when you were using the app.

undefinedLyft breaks down their coverage based on three phases:

  • “App Off”: If your Lyft app is off, it’s up to your personal policy to cover you.
  • “App On/Driver Mode”: This is the phase when the driver has the Lyft app on but has not been matched with a fare. During this period, Lyft will cover auto liability up to $50,000 per person for bodily injury, up to $100,000 per accident where bodily injury occurred, and up to $25,000 per accident where property damage occurred. Unfortunately, Lyft will not provide Lyft driver’s with collision coverage during this phase.
  • “Match Notification-Dropped Off Passenger”: Any time between the periods of “match notification” and “dropped off passenger,” Lyft will cover auto liability up to $1 million and cash value or repair cost for collision and comprehensive coverage up to $50,000, with coverage limits varying by state. However, please note that there is a $2,500 deductible for Lyft drivers utilizing the collision coverage. During this phase, Lyft will also provide the Lyft driver and any passengers up to $1,000,000 of Uninsured or Underinsured coverage for any injury sustained in an accident. This means that if you are injured during a Lyft ride and the at fault party has either no coverage or not enough coverage, Lyft will step in and cover you for up to $1,000,000.

Whether you are entitled to compensation for injuries sustained while driving a Lyft may depend on what evidence you can gather. A skilled Lyft accident attorney will use screenshots from the app, testimony from riders, or rulings from your own insurance company to negotiate the best possible settlement, and make sure you don’t lose your ability to work and make a living as a driver for an accident that was not your fault.

What Passengers Need to Know

While Lyft’s insurance policies may seem like they are designed to protect riders in case of an accident, they’re really just designed to protect the company. This is why it’s advisable to hire a lawyer in case you get into an accident while in a Lyft, and to document the severity of your injuries swiftly and thoroughly. The quicker you act and the better prepared you are, the greater chance that a lawyer will be able to argue on behalf of a large settlement in court.

What Pedestrians Need to Know

Due to a tragic case from 2011, in which a driver killed a six-year-old girl, rideshare companies have a legal precedent forcing them to settle in cases involving pedestrians. A skilled Lyft accident attorney will be able to use this precedent to argue negligence on your behalf and work to secure the largest settlement possible.
