Uber Accident Attorney

Fighting for Victims of Uber Accidents

The rise of the ridesharing industry has also meant the rise of ridesharing accidents. Whether you are a driver, rider, or pedestrian, being involved in one of these accidents is never okay. Because this industry is so new, it can be hard to hold the right person accountable, and make sure you are getting the justice you deserve.

This is why you should consider hiring an experienced Uber accident lawyer to take your case. Uber has grown massively since the company was first founded less than a decade ago, and it’s unfair for the average citizen to have to face their considerable legal resources alone. Before you talk to an insurance adjuster or to the company itself, you should talk to a law firm that can help you gain leverage in negotiations and fight to get you the compensation you deserve.

At Omega Law Group, PC we want to be that law firm. Our professional team has years of experience when it comes to auto accidents and we are dedicated to providing specialized attention and 24/7 availability to each of our clients. If you have been injured in an Uber accident, don’t wait.

More Ridesharing, More Problems

According to a joint study from the University of Chicago and Rice University, ridesharing services have increased traffic deaths between 2-3% in the United States since 2011. The study was conducted by examining accident rates in cities relative to vehicle miles traveled. On average, statistics indicate that people who drive for companies like Uber spend more time in their cars, leading to increasingly congested roads and greater chances for collision.

What Victims Need to Know

Uber is worth billions of dollars, and their drivers are ensured through James River Insurance Company for up to $1 million for liability and uninsured/underinsured motorist coverage. Because of the company’s extensive insurance policies, those injured in an accident where they are not at fault may be able to seek higher compensation for medical costs, damages, lost income, and any other pain and suffering.

If you were injured in an Uber accident, you may be entitled to damages if you are:

  • A motorist or passenger injured in a collision where an Uber driver is at fault;
  • An Uber driver inured in a collision with another motorist where the other motorist is at fault;
  • An Uber passenger injured in any kind of collision, or;
  • A pedestrian injured in an Uber-related collision.

Dealing with Insurance Companies

If an accident involves damage to a vehicle but no injuries, you may be able to work it out with your insurance company. If you are an Uber driver, there is a $1,000 deductible for any damage, regardless of whether the accident was your fault. It’s a good idea to seek representation before talking to an adjuster though, as they may be able to help you craft an argument which results in the least possible reduction in coverage and least possible increase in rates.

What Can I Expect If I Am a Driver?

If you’re an Uber driver, whether or not you receive coverage may depend on when you were driving.

undefined

Coverage for Uber drivers is dependent on whether they were driving during one of these times:

  • PHASE 1 - While waiting for a request: If you are online on the Uber app before you accept a request, you are covered for liability only with a third party in an accident where you’re at fault. Coverage may include liability to pay someone’s medical bills or damage to their vehicle. While coverage limits vary by state, they include anywhere between $50,000 and $100,000 for bodily injury, and $25,000 for damage to a vehicle. If you are not at fault, you can make a claim against the third party’s insurance, or see if your personal insurance policy will cover the accident.
  • PHASE 2 and PHASE 3 - While driving to pick up a rider and during a trip: After you accept a request and during a ride, Uber will cover third party liability coverage where you are at fault, with limits varying by state but totaling at least $1,000,000 per accident. In these cases, Uber will cover uninsured or underinsured injury coverage where the other driver is at fault but does not have any or sufficient coverage, including hit and run accidents where fault can’t be identified, with limits varying by state but totaling at least $1,000,000 per accident. Uber will cover collision coverage (vehicle repairs) on your vehicle in this circumstance whether it was the driver’s fault or not, as long as the Uber driver has insurance on their personal policy that includes collision coverage that extends to when they are not using Uber. There is a $1,000 deductible in these cases.
  • While driving for personal use: Uber’s insurance does not cover drivers who get into an accident while driving their vehicle for personal use.

A skilled Uber accident attorney will take all these timeframes into consideration when determining what compensation you may be entitled to. Information from the app, passenger testimony, and determinations by your own insurance company may be used in negotiating a potential settlement. Acting quickly is in your best interest, especially as the company may turn off your app, and interfere with your ability to earn a living while an investigation is being conducted.

What Can I Expect If I Am a Rider?

Any Uber accident attorney who knows what they are doing will tell you it’s easier to secure a settlement as a rider than as a driver. Since passengers are innocent victims in accidents, they should be entitled to compensation, which is why it’s important to hire a lawyer as soon as possible if you get hurt during an Uber ride. Most critically, you will have to document your injuries. The worse the injuries, the bigger the settlement you are entitled to, and the more you will need an attorney who knows how to negotiate that settlement.

What Can I Expect If I Am a Pedestrian?

After a horrible incident in 2013 where an Uber driver hit and killed a six-year-old-girl, the company has set a precedent of settling cases where pedestrians are involved. This is not to say that you won’t need to fight for every penny you deserve. Uber will bring all their legal fire power to argue the settlement down as much as possible. That’s why it’s key to hire an experienced Uber attorney who can argue to get you everything you deserve, and prove beyond a shadow of a doubt the existence of egregious negligence on the part of the company and the driver involved in the accident.
