What Causes Bicycle Accidents?

People tend to blame bicyclists for accidents even before they know anything about what happened. This bias puts bicycle riders in an unfair starting situation when working on a case, especially when considering that many accidents are caused directly and solely by a motorist’s mistakes.

Drivers can cause bicycle accidents if they:

  • Tailgate bicyclists, who can brake much faster than a car.
  • Change lanes without checking mirrors and blind spots.
  • Drive in or through bike lanes.
  • Refuse to share the road with cyclists.

We need to know how your bicycle accident happened if we want to get you a fair amount of compensation when your case concludes. An in-depth investigation of your accident and its circumstances might be in order. We have a full team of attorneys who can combine their talents and experiences for complex and high-stakes cases. If the opposition is putting up a serious fight, then you can rest assured that the Omega Law Group has your back!

Are Drivers Required to Share the Road?

Did the driver who hit you say that you are to blame because you “shouldn’t have been riding in the road” in the first place? This argument is not a valid defense against liability because motorists are required to share the road with cyclists whenever possible. The only exception is that bicyclists should use and stay in bicycle lanes if they are available. Your helmet cam footage could be the best evidence available to prove that you were not unlawfully using the road at the time of the accident.

Sidewalk Rules in Los Angeles

The City of Los Angeles allows bicyclists to ride on the sidewalk responsibly. Specifically, the law disallows using the sidewalk on a bicycle if you do so with “willful and wanton disregard” for others. If your bicycle accident was caused by a pedestrian who walked in front of you or shoved you while you were on the sidewalk, then you can still sue them for compensation.
