California Pedestrian Right of Way Laws

Drivers have a responsibility to look out for pedestrians, but pedestrians also have a duty to cross safely and in accordance with California's right of way laws.

California's Vehicle Code specifies that drivers must adhere to the following laws in respect to pedestrians:

  • Drivers must yield to crossing pedestrians within marked crosswalks as well as unmarked crosswalks at intersections.
  • Drivers must not pass stopped vehicles at crosswalks, as the stopped vehicle may be allowing a pedestrian cross.
  • Drivers may only drive on the sidewalk to enter or exit a garage or alleyway, and they must still yield to pedestrians when doing so.
  • Drivers must not stop in a crosswalk, as this puts pedestrians who have to walk around the vehicle at risk.
  • Pedestrians are prohibited from jaywalking and may be held liable for collisions caused by drivers attempting to avoid jaywalkers.

While these laws may absolve drivers from criminal wrongdoing, they do not completely eliminate fault in the event of a crash. Drivers must still exercise due care to avoid hitting a pedestrian even if they are crossing illegally. Likewise, pedestrians cannot suddenly step off a curb if there are cars nearby or otherwise stop in the middle of an intersection and obstruct traffic even if they have the right of way. Both drivers and pedestrians must be aware of their surroundings and act accordingly.
